Chapter 7 bankruptcy is the most common type of bankruptcy filed in California. In order to file for Chapter 7 protection you must qualify, which involves passing a couple of tests that involve your income and expenses. In a Chapter 7 bankruptcy case a bankruptcy “trustee” is appointed whose job it is to sell any assets that we cannot protect to generate funds for your creditors. In most cases all the assets can be protected through “exemptions” which differ from state to state. In California, we have two schemes of exemptions which we get to choose between. If you pass both income tests and have no assets that are left unprotected, then Chapter 7 is the right option for you. If that is not the case you may need to file for Chapter 13 protection.
If Chapter 13 bankruptcy is the right move for you, we will create a repayment plan that you can afford. Be assured that you will have enough funds every month for your living expenses and to make payments on your secured debts such as your home mortgage and auto loan. Through Chapter 13 you pay your disposable income to your creditors, through the bankruptcy court, and after three to five years, the remaining debts will be “discharged” and you’re debt-free. Many Chapter 13 debtors end up paying only pennies on the dollar for their unsecured debts.
